This case took place about a decade ago, back in 2013. It was the time when India faced its first ever cyber conviction.

It all begins when Sony India filed a complaint against Arif Azim. Arif was a resident of Noida, U.P.
Company’s Profile:-
Sony.Sambandh was a newly launched business venture of Sony India where it targets non-residents(NRIs) who wishes to give Sony products to their friends and family members residing in India. According to the company’s policy, the client has to make the payment first after placing their order. Upon finishing this process, the order is confirmed and the company undertakes the products to deliver to the concerned persons in India.
How the incident took place?
It took place in the month of May,2022. According to the cybercrime case study, one login calling in the name of Barbara Campa logged in and an order of Sony Television and a cordless headphone was placed. She gave her credit card number to make the payment and requested to send the products to Arif Azim in Noida. The transaction was completed after the credit card company properly cleared the payment. The company delivered the goods to Arif Azim after carrying out the necessary formalities..
The delivery team captured digital photos of Arif Azim accepting the delivery at the moment of delivery. The transaction was closed at that point, but after a month and a half, the credit card company notified the business that the purchase was unauthorised because the legitimate owner had denied making it.
Lodging the complaint:-
The Central Bureau of Investigation received the company’s allegation regarding internet cheating and filed a case under Sections 418, 419, and 420 of the Indian Penal Code. After an investigation, Arif Azim was taken into custody. According to investigations, Arif Azim obtained an American national’s credit card number while working at a call centre in Noida and used it fraudulently on the business’ website. In this unique case of cyber fraud, the CBI was able to recover the colour television and the wireless headphones. The accused acknowledged his guilt in this case since the CBI had proof to support their claims. The court found Arif Azim guilty of cybercrime for the first time, citing Sections 418, 419, and 420 of the Indian Penal Code.
The final verdict:-
However, the court believed that a liberal stance was required because the accused was a young kid of 24 and a first-time offender. As a result, the court granted the accused a one-year probationary period. The ruling has enormous implications for the country as a whole. In addition to becoming the first conviction in a cybercrime case, it has demonstrated that some cybercrimes not covered by the Information Technology Act 2000, can be successfully prosecuted under the Indian Penal Code. Second, a ruling like this makes it quite evident that the law cannot be taken lightly.
